Terms of Service

The terms that govern your use of the Pindo website and Voice AI platform.

These terms govern your access to pindo.ai and to the Pindo Voice AI platform (the "Service"). By using the Service you agree to them. If you are agreeing on behalf of a company, you confirm you have authority to bind that company.

The Service

Pindo provides Voice AI agents and related APIs that let your customers access services over a phone call in their own language. Access is granted to you as a non-exclusive, non-transferable right to use the Service in accordance with these terms and any order form or written agreement we sign with you. Where a signed agreement conflicts with these terms, the signed agreement governs.

Accounts

You are responsible for the accuracy of your account details, for keeping your credentials and API keys confidential, and for all activity that happens under your account. Tell us promptly at [email protected] if you suspect unauthorised use.

Acceptable use

You agree not to use the Service to:

  • Place calls or send messages that recipients have not consented to receive, or that breach telecommunications, marketing, or consumer protection law.
  • Impersonate a person or organisation, or misrepresent that a caller is human where the law requires disclosure of automated systems.
  • Commit fraud, harass, defraud, or deceive any person.
  • Distribute malware, probe or breach security controls, or attempt to disrupt the Service or the networks it depends on.
  • Reverse engineer the Service or use it to build a competing product, except where such a restriction is unenforceable by law.

We may suspend access without notice where use presents a legal, security, or network-integrity risk, and will restore it once the issue is resolved.

Your content and data

You retain all rights in the data you and your end users submit to the Service, including audio, transcripts, and configuration ("Customer Data"). You grant us the rights necessary to process Customer Data in order to provide the Service. You are responsible for having a lawful basis — including any recording notices and consents required in your jurisdiction — for the calls you place or receive through the Service. Our handling of personal data is described in the Privacy Policy.

Fees

Paid plans are billed as set out in your order form or plan description. Unless stated otherwise, fees are exclusive of taxes, non-refundable, and due on the terms invoiced. We may change pricing with reasonable prior notice, effective at your next renewal.

Availability and support

We work to keep the Service available and performant, and publish availability commitments in the service level terms of a signed enterprise agreement where one exists. Absent such an agreement, the Service is provided without an uptime guarantee. We may modify or discontinue features; where a change is material and adverse, we will give reasonable notice.

Third-party services

The Service depends on third parties, including telephony carriers and cloud providers. We are not responsible for their acts, omissions, or outages beyond our reasonable control, and your use of any third-party integration is subject to that provider's own terms.

Intellectual property

Pindo and its licensors own the Service, including all software, models, and documentation, and all associated intellectual property rights. Nothing in these terms transfers those rights to you. Feedback you send us may be used freely to improve the Service.

Disclaimers

Except as expressly stated, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including fitness for a particular purpose, merchantability, or non-infringement. AI-generated output can be inaccurate; you are responsible for reviewing output before relying on it for decisions that affect people.

Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. These limits do not apply to liability that cannot be excluded by law.

Indemnity

You will defend and indemnify Pindo against third-party claims arising from your use of the Service in breach of these terms or of applicable law, including claims brought by your end users about calls you initiated.

Term and termination

These terms apply for as long as you use the Service. Either party may terminate for material breach that remains uncured 30 days after written notice. On termination your access ends and we will delete or return Customer Data in accordance with the Privacy Policy and any signed agreement.

Governing law

These terms are governed by the laws of the Republic of Rwanda, and the courts of Kigali have exclusive jurisdiction, unless a signed agreement between us specifies otherwise.

Changes

We may update these terms as the Service evolves. The date at the top of this page reflects the last substantive revision, and material changes will be announced here before they take effect. Continued use after a change means you accept the updated terms.
